These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Caring For Them ("Company," "we," "us," or "our") governing your access to and use of our website and services.

By using our website or submitting information to us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree, kindly choose not to use our services.

Caring For Them provides senior living placement and referral services. We assist individuals and families in identifying and connecting with independent living, assisted living, memory care, and other senior housing options.

We are a referral service only and do not own, operate, manage, or control any senior living communities or care providers.

We are NOT a health care provider, insurer, or HIPAA covered entity.

Our services do not constitute medical, legal, financial, or professional advice.

• We do not provide diagnoses or healthcare services
• We do not evaluate clinical appropriateness of facilities
• Any decisions regarding care should be made in consultation with licensed professionals

Information provided through our services is for informational and referral purposes only.

We do not guarantee:

• Placement in any specific community
• Availability of housing or care services
• Pricing, amenities, or quality of care

All final decisions, agreements, and arrangements are made directly between you and the senior living provider.

By using our services, you agree to:

• Provide accurate and truthful information
• Not misrepresent care needs, financial ability, or identity
• Use our services only for lawful purposes

You are solely responsible for evaluating any community or provider before making a decision.

Caring For Them operates on a commission-based referral model.

• We may receive compensation from senior living communities when a placement is made
• Compensation is typically based on a percentage of the first month's rent or other agreed terms
• This compensation does not increase the price you pay to the community

By using our services, you acknowledge and consent to this compensation structure.

Important note about this referral model, Caring For Them will NEVER prioritize a facility that pays a higher commission over a facility that best suites the senior's needs, even if the best suited facility pays a lower commission.

By submitting your information, you authorize us to:

• Contact you via phone, email, or text
• Share your information, including relevant care needs, with senior living communities and care providers

Your use of our services constitutes consent as described in our Privacy Policy.

Senior living communities and care providers are independent third parties and are not employees, agents, or representatives of Caring For Them.

We are not responsible for:

• The acts, omissions, or conduct of any provider
• Quality of care, safety, or services provided
• Any agreements entered into between you and a provider

Though we will always do our best to recommend a facility that we can endorse with confidence, you will need to agree that your interactions with such third parties are at your own risk.

To the fullest extent permitted by law:

Caring For Them shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

• Personal injury or health outcomes
• Dissatisfaction with a facility or provider
• Financial losses or disputes
• Service interruptions or delays

Our total liability for any claim shall not exceed the amount of compensation received by us in connection with the applicable referral, or $500, whichever is less.

Our services are provided on an "as-is" and "as-available" basis.

We make no warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Accuracy or completeness of information

We do not guarantee that the website or services will be uninterrupted or error-free.

You agree to indemnify, defend, and hold harmless Caring For Them and its owners, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

• Your use of the services
• Your violation of these Terms
• Your interactions with third-party providers

Your use of our services is also governed by our Privacy Policy.

By using our services, you consent to the collection, use, and sharing of your information as described therein.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Northeast Florida.

At our discretion, we may require that disputes be resolved through binding arbitration in the State of Florida.

You agree to waive any right to participate in class actions or class-wide arbitration.

We reserve the right to modify these Terms at any time.

Changes will be effective upon posting. Continued use of our services constitutes acceptance of the revised Terms.

We reserve the right to suspend or terminate access to our services at any time, without notice, for any reason, including violation of these Terms.
